Loaded Hearse vs Transit Lanes

In the US, a transit lane (one for two or more people per vehicle) are (apparently) called "diamond lanes". A article at Snopes, discusses these and answers the critical question:

And no, lone hearse drivers transporting clients to their final rests cannot use the diamond lane.

I have checked with an inside contact at the RTA (the people who make the road rules in NSW) and he responds to the question "Can a hearse use the transit lane?":

From my understanding it can - there is no definition on the state of the 2nd/3rd/4th person in the motor vehicle...
